ANÁLISIS DEL PROCESO JUDICIAL EN CASOS DE ABUSO SEXUAL INFANTIL. PERSPECTIVA DE LAS PSICÓLOGAS DE LA CLÍNICA MÉDICO FORENSE DE MADRID

Resumen

La presente investigación, cuyo carácter es descriptivo y cualitativo, tiene como finalidad conocer el proceso judicial por el que atraviesan los casos de abuso sexual infantil denunciados y el rol del psicólogo forense en este proceso. Como instrumento se utilizó una entrevista semiestructurada que fue aplicada a cada una de las psicólogas pertenecientes a la Clínica Médico Forense de Madrid. Entre los resultados encontrados, destacan que: 1) el proceso judicial por el que atraviesan estos niños se caracterizaría por ser lento e involucrar múltiples declaraciones por parte de los niños y sus familias; 2) el rol de las psicólogas sería fundamentalmente de evaluadoras, tanto de la credibilidad del testimonio de los niños como de su estado psicológico y posibles secuelas; y 3) que las principales dificultades encontradas en su trabajo por las psicólogas entrevistadas, consistiría en: la lentitud del proceso, la escasez de recursos profesionales y la escasa formación y preparación en el tema por parte de otros profesionales involucrados en el proceso.

Abstract

The aim of this investigation, of a descriptive and qualitative nature, is to examine the judicial process undergone in the denounced cases of sexual abuse in infancy and the role of the forensic psychologist in this process. A semi-structured interview was administered to each of the psychologists belonging to the Medical Forensic Clinic of Madrid. Among the results, we highlight that: (1) the judicial process undergone by these children is characterized by being slow and involving many declarations by the children and their families; (2) the psychologists’ role is chiefly to assess the children’s credibility, as well as their psychological status and possible sequelae; and (3) the main difficulties encountered by the psychologists we interviewed consisted of the slowness of the process, the lack of professional resources and of training and preparation in this matter by other professionals involved in the process.
