EVALUACIÓN NEUROPSICOLÓGICA Y CLÍNICO-FORENSE EN UN SUPUESTO DE INCAPACIDAD PERMANENTE ABSOLUTA POR ENFERMEDAD DE MÉNIÈRE

Resumen
La neuropsicología forense es una subespecialidad emergente que conlleva la aplicación de la neuropsicología clínica en el campo legal, respondiendo a las preguntas que se dan en el contexto jurídico a través de métodos de evaluación neuropsicológica. Concretamente, en la jurisdicción laboral, la neuropsicología forense puede auxiliar en materia de bajas laborales (variables neurocognitivas y afectivas), incapacidad laboral (valoración funcional en el ámbito del trabajo) y accidentes de trabajo (validez de síntomas y variables neuropsicológicas relacionadas con el estado psicológico y neurológico). En el caso presente se realiza una evaluación pericial a una persona con Síndrome de Ménière y diagnóstico de depresión y ansiedad. El objetivo es valorar el impacto funcional (criterios de rendimiento y empleabilidad) en el contexto de una incapacidad permanente absoluta. Se concluye que, junto con los problemas médicos señalados, los indicadores psicopatológicos de naturaleza emocional y las alteraciones cognitivas asociadas son incompatibles con el desempeño laboral en cualquier puesto de trabajo con un mínimo de profesionalidad, rendimiento y eficacia.

Abstract
A neuropsychological and clinical-forensic evaluation in a case of absolute permanent invalidity for work due to Ménière's disease. Forensic neuropsychology is an emerging subspecialty that involves the application of clinical neuropsychology in the legal field, responding to questions that arise in the legal context through neuropsychological assessment methods. Specifically, in the labour jurisdiction, forensic neuropsychology can help in matters of sick leave (neurocognitive and affective variables), invalidity for work (functional assessment in the field of work) and accidents at work (validity of symptoms and neuropsychological variables related to the psychological and neurological state). In the present case, an expert assessment was conducted on a person with Ménière's syndrome and a diagnosis of depression and anxiety. The objective is to assess the functional impact (performance and employability criteria) in the context of absolute permanent invalidity. It is concluded that, in conjunction with the medical problems indicated, the psychopathological indicators of an emotional nature and the associated cognitive alterations are incompatible with the performance of any job with a minimum of professionalism, performance and efficiency.
